Vendor Rules

I. Operations and Setup

1. Hours of Operation:
  • The market is open to the public from 9am to 4pm on Sunday.
  • Vendors must be fully set up and ready to sell no later than 9am.
  • Vendors may not begin tear-down before 4pm unless granted explicit permission from market management. Early tear-down is disruptive and strictly prohibited.
2. Setup and Load-in/Load-out:
  • Load-in: Vendors may begin setting up at 6am. All vehicles must be unloaded and moved to the designated vendor parking area by 8:30 to ensure public safety and access.
  • Load-out: Vehicles are not permitted back into the market area until the market closes at 4:15.
  • Space Boundaries: Vendors must display merchandise only within the boundaries of their rented space. Merchandise may not obstruct walkways or neighboring stalls.
3. Booth Appearance:
  • Spaces must be kept clean, tidy, and professional throughout the day.
  • All trash and unsold merchandise must be removed from the space at the end of the day. Do not use market trash receptacles for disposing of merchandise or large amounts of debris. Leave your space as clean as you found it.

II. Merchandise Guidelines

4. Permitted Items:
  • All items must be legal to sell under local, state, and federal laws.
5. Prohibited Items (Strictly Enforced):

The following items are strictly prohibited from being sold or displayed:

  • Firearms, ammunition, or weapons (including airsoft, pellet, or realistic replica guns).
  • Illegal drugs, drug paraphernalia, or CBD/THC products (unless specifically licensed by market management).
  • Any item promoting hate speech, violence, or discrimination.
  • Pornography or sexually explicit material.
  • Stolen or counterfeit merchandise.
6. Food and Sales:
  • Sales of prepared food are only permitted by vendors with a valid Monterrey County health permit and explicit, prior approval from market management.
  • Beverage Prohibition: The sale, sampling, or giveaway of all beverages (bottled water, sodas, juices, coffee, beer, alcoholic beverage, etc.) is strictly prohibited by all vendors, regardless of food permit status, to avoid conflict with designated market concessionaires.

III. Financial and Administrative

1. Space Fees and Payment (Monthly Billing):
  • Payment Deadline: For all monthly or recurring space rentals, the full space rental fee must be received by market management no later than 7 days prior to the first day of the following month.
  • Late Payment/Forfeiture: If payment is not received by this deadline, the reserved space will be considered immediately available and will be rented to another vendor without further notice. 101 RED BARN LLC is not responsible for notifying the vendor before re-renting the space after the deadline has passed.
  • No refunds or rain checks will be issued for cancellations or no-shows or rainy days no exception.
8. Licensing and Taxes:
  • Vendors are solely responsible for obtaining all necessary business licenses, permits, and tax identification numbers required by local, state, and federal authorities.
  • Vendors are responsible for the collection and remittance of all applicable sales tax.
9. Subletting:
  • Vendors may not sublet, share, or transfer their reserved space to another individual or business without prior written consent from market management.

IV. Conduct and Safety

10. Professional Conduct:
  • Vendors must conduct themselves in a courteous and professional manner toward customers, market staff, and other vendors at all times.
  • Aggressive sales tactics, loud music, or any behavior that negatively impacts the market atmosphere is prohibited.
11. Market Management Authority:
  • Market management has the final authority to interpret and enforce these rules.
  • Market management reserves the right to ask any vendor to immediately remove any merchandise deemed offensive, unsafe, or in violation of these rules.
  • Failure to comply with these rules or the instructions of market management may result in the immediate revocation of your vendor privileges and removal from the premises without a refund.
12. Liability:
  • Vendors are responsible for the safety and security of their own merchandise, money, and personal property.
  • 101 RED BARN LLC is not responsible for any loss, theft, or damage to property or injury to persons occurring at a vendor's space. Vendors agree to indemnify and hold harmless the market, its owners, and its employees from any such claims.

Vendor Acknowledgement

By reserving and setting up a space at 101 RED BARN LLC, the vendor acknowledges that they have read, understood, and agree to abide by all the rules and regulations outlined above.
